Editor Jason Chen, from Gizmodo, is breathing a little easier now after a California DA decided to withdraw the search warrant involving the infamous “lost iPhone 4” prototype.

On Friday, it was reported that Chen agreed to cooperate with officials investigating the iPhone 4 prototype that was purchased from Brian Hogan, who found the handset in a bar in California. Gizmodo told the Wall Street Journal that Chen’s possessions that were seized, including computers and digital storage devices, have been returned.

So if Gizmodo/Chen do not wind up being charged with any “crimes” here, where does this leave Hogan? Could officials be working on a case to bring charges against him? Should they? Let us know what you think.
